Terms of Service

These Terms of Service (“Terms”) govern your access to and use of RaceCrewMedia News (the “Site”), operated by RaceCrewMedia (“RaceCrewMedia,” “we,” “us,” or “our”). The Site offers motorsports-related news, photography, photo galleries, race-weekend hubs and live coverage, video embeds, a merchandise shop, and related editorial content.

By accessing or using the Site, you agree to these Terms, our Privacy Policy, and our Cookie Policy. If you do not agree, do not use the Site.

Eligibility

The Site is offered to users who can form a binding contract under applicable law. If you use the Site on behalf of an organization, you represent that you have authority to bind that organization. The Site is not intended for children under 13; see our Privacy Policy for more information.

Accounts

Some features require or allow an optional account (for example contributors posting live updates or managing profile information). You are responsible for maintaining the confidentiality of your credentials and for activity under your account. Notify us promptly through Contact Us if you suspect unauthorized access. We may suspend or terminate accounts that violate these Terms or pose a security risk.

Acceptable use

You agree not to:

  • Use the Site in any way that violates applicable law or infringes others’ rights;
  • Attempt to gain unauthorized access to the Site, our systems, other users’ accounts, or data;
  • Interfere with or disrupt the Site or servers (for example by introducing malware, excessive automated requests, or denial-of-service activity);
  • Scrape, harvest, or collect content or personal data from the Site through automated means without our prior written consent, except as allowed by public search engines’ ordinary indexing or applicable law;
  • Download, copy, or redistribute photo gallery images or other Site content for commercial use without a separate license from RaceCrewMedia;
  • Misrepresent your identity or affiliation, or harass staff, contributors, or other users.

Intellectual property

Unless otherwise noted, the Site’s editorial content—including articles, headlines, layout, original photography and graphics, logos, and trademarks identifying RaceCrewMedia or RaceCrewMedia News—is owned by RaceCrewMedia or its licensors and is protected by copyright, trademark, and other intellectual property laws.

We grant you a limited, personal, non-exclusive, non-transferable license to access and view the Site and to share links to our pages for non-commercial purposes, subject to these Terms. You may not copy, reproduce, republish, upload, transmit, modify, create derivative works from, distribute, publicly display, or sell any Site content without our prior written permission, except as permitted by law (for example fair use or fair dealing) or as expressly allowed by sharing tools we provide.

Photo galleries. Viewing photos on the Site does not grant you a license to use those images commercially, in print, or on merchandise. Commercial or editorial licensing may be available through separate agreement; contact us via Contact Us or use an invitation we provide to our license portal.

Third-party trademarks, team names, series logos, and sponsor marks appearing in editorial coverage may belong to their respective owners; their appearance does not imply endorsement unless expressly stated.

User content (live updates and similar)

If you submit content through the Site while signed in (for example short race-weekend live updates or photos where enabled), you represent that you have the right to submit it and that it does not violate law or third-party rights. You grant RaceCrewMedia a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute that content in connection with the Site and our motorsports coverage (including archival and promotional use of coverage), without compensation unless we agree otherwise in writing. We may remove or refuse content at our discretion.

Copyright and takedown requests

We respect intellectual property rights. If you believe material on the Site infringes your copyright, send a detailed notice to the contact information on our Contact Us page, including: identification of the work, identification of the material and its location on the Site, your contact information, a statement of good-faith belief that use is not authorized, a statement under penalty of perjury that your notice is accurate and that you are the rights holder or authorized to act, and your physical or electronic signature. We may remove or disable access to material we determine should be removed consistent with applicable law.

Third-party links, embeds, and shop

The Site may contain links to third-party websites or embedded players (for example YouTube). We do not control and are not responsible for third-party content, terms, or privacy practices.

Our Shop may list products fulfilled by Fourthwall or other partners. Checkout, payment, shipping, returns, and refunds are governed by the applicable merchant’s terms and policies. RaceCrewMedia is not responsible for third-party fulfillment errors except as required by law.

Business clients accessing our photo license portal via a private link are also subject to the terms presented in quotes, agreements, and PDFs provided through that workflow.

Advertising and sponsorships

The Site may display advertisements or sponsored placements (including programmatic ads and event sponsors). Sponsored or paid content will be identified when required by law or our editorial standards. Advertisers are responsible for their own claims; advertising does not constitute our endorsement unless clearly stated.

Editorial disclaimer

Motorsports involve inherent risks. Coverage on the Site is for informational and entertainment purposes. Nothing on the Site constitutes professional advice (including safety, technical, or legal advice). Always follow venue rules, sanctioning-body regulations, and applicable law. We strive for accuracy but do not warrant that content is complete, current, or error-free. Live updates and schedules may change without notice.

Disclaimer of warranties

THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, RACECREWMEDIA DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR FREE OF ERRORS OR HARMFUL COMPONENTS.

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL RACECREWMEDIA, ITS AFFILIATES, CONTRIBUTORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS (US $100) OR (B) THE AMOUNTS YOU PAID US (IF ANY) FOR ACCESS TO THE SITE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

Indemnity

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless RaceCrewMedia and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Site, content you submit, your violation of these Terms, or your violation of any third-party rights.

Changes to the Site or Terms

We may modify, suspend, or discontinue the Site or any feature at any time. We may also update these Terms; the “Last updated” date will change when we do. If changes are material, we may provide additional notice on the Site. Your continued use after changes become effective constitutes acceptance of the revised Terms. If you do not agree, stop using the Site.

Governing law and venue

These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law rules. Subject to applicable law, you agree that exclusive jurisdiction and venue for disputes arising from these Terms or the Site will lie in the state or federal courts located in North Carolina, and you consent to personal jurisdiction there.

General

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in effect. Failure to enforce a provision is not a waiver. These Terms, together with the Privacy Policy, Cookie Policy, and any additional terms we present for specific features (including license portal documents), constitute the entire agreement between you and RaceCrewMedia regarding the Site.
